The legitimacy of the Zionist project--establishing a Jewish homeland in Palestine--has been questioned since its inception. In recent years, the voices challenging the legitimacy of the State of Israel have become even louder. Chaim Gans examines these doubts and presents an in-depth, evenhanded philosophical analysis of the justice of Zionism. Today, alongside a violent Middle East where many refuse to accept Israel's existence, there are two academically respectable arguments for the injustice of Zionism. One claim is that the very return of the Jews to Palestine was unjust. The second argument is that Zionism is an exclusivist ethnocultural nationalism out of step with current visions of multicultural nationhood. While many therefore claim that Zionism is in principle an unjust political philosophy, Gans seeks out a more nuanced ground to explain why Zionism, despite its manifest flaws, could in principle be just. Its flaws stem from the current situation, where exigencies have distorted its implementation, and from historical forces that have ended up favoring an extreme form of Jewish hegemony. For Gans, the justice of Zionism and of Israel are not black-and-white propositions. Rather, they are projects in need of repair, which can be achieved by reconceptualizing the Jews' relationship with the Palestinian population and by adhering to a significantly more limited version of Jewish hegemony. Ultimately, A Just Zionism offers a concrete, historically and geographically rooted investigation of the limits of contemporary nationalism in one of the world's most fraught cases.

The Rules of Civil Procedure for the Magistrate Courts of West Virginia were promulgated by the Supreme Court on June 22, 1988. This Handbook provides guidance on how those rules should be applied. In addition, this Handbook provides guidance on how to apply legislative procedural statutes that are applicable to magistrate courts. It must be emphasized that this Handbook is only a reference tool, it does not purport to be the “law.” The magistrate court system replaced the justice of the peace courts, pursuant to Article VIII, § 15 of the state constitution, on January 1, 1977. During the long period in which the justice of the peace court system was in place, a rich body of case law was created. Whenever possible this Handbook references to case law decided for justice of the peace courts, as illustrative on how specific issues should be handled by magistrates. In addition, the Handbook provides case law guidance on issues decided under the rules of civil procedure for circuit courts. This Handbook is intended to be user-friendly. In doing so, the material in this Handbook has been arranged under each Rule that is set out in the Rules of Civil Procedure for the Magistrate Courts. To the extent that the Handbook covers procedural matters only found in statutes and other administrative rules promulgated by the Supreme Court, such matters have been set out near closely related Rules.

Despite the advances made by the international community to outlaw the resort to force by the United Nations Charter, armed conflicts both international and non-international are a fact of every day life. The civilian casualties from such conflicts have assumed catastrophic proportions. Little attention, however, has been paid by scholars to the treatment of noncombatants in armed conflict and the place in international law of the principle fundamental to the law of armed conflict: noncombatant immunity. This work aims to remedy this omission. The author analyses in detail the content of the customary and conventional rules that give effect to this principle, in both international and non-international armed conflict. The importance of such a study is highlighted by the recent Gulf conflict where so many of the States were not bound by the most recent treaty rules protecting noncombatants.

The book questions the classic idea of self-determination – the right to self-determination is a right of peoples, not of minorities – by examining the content of the right to self-determination and the content of minority rights. Self-determination has four dimensions: the political, the economic, the social and the cultural dimensions. Minorities have minority rights that touch on most aspects of life as a member of a minority. If there is an overlap between minority rights and the different dimensions of self-determination, the concept that the right to self-determination is only applicable to peoples loses credibility. No global and general conclusion is envisaged; there are restrictions in place. The work is limited to the European framework and is further restricted to classic minorities. The argument is based on a legitimacy and justice approach. The analysis in this book shows that some minority rights overlap with the different dimensions of internal self-determination. In short, classic minorities in Europe have a right to internal self-determination.

On Exceeding Determination and the Ideal of Reason: Immanuel Kant, William Desmond, and the Noumenological Principle examines the critical philosophy of Immanuel Kant, as it bears on theological principles. Focusing on the foundational ideas (of self, world, and God) that constitute Kant’s metaphysical system, Shaw argues that these ideal projections of the rational structures of the thinking subject only conceal and obfuscate the more robust sense of the real that exists behind all phenomenal appearances. This book aims to critically assess the theological content presented in the philosophy of Kant whilst reconstructing and developing some of Kant’s more obscure points on the epistemological limitations of pure reason and the borders of knowledge itself. Shaw draws into dialogue with the writings of the contemporary philosopher William Desmond to demonstrate some of the problems of Kantian thought when it comes to the deeper mysteries of being. Desmondian philosophy proves to be a powerful influence over much of this work, as Shaw advances upon the delicate nexus where philosophy and theology convene. As a bold addition to this work, Shaw lays the groundwork for a new discourse in theology and the philosophy of religion: “Noumenology”. Noumenology, which is Shaw’s response to the deficiencies in methods concerning many of the modern approaches to phenomenology, is a call for the recalibration of the starting point for eidetic inquiry through the proposal of a non-discursive approach to the sensible, emotional, and intellectual – or perhaps, the all together spiritual. To accomplish this, Shaw reaches back to Kant for a heterodox approach to the language and content surrounding the noumenonal to set forth his theological interpretation of the “Noumenological Principle”.
